Terms of Service

1. Agreement to Terms

Welcome to OTFT. These Terms of Service ("Terms") form a legal agreement between you and Chaise Chumadevsky, doing business as OTFT ("OTFT", "we", "us", "our"). By downloading, accessing, or using the OTFT mobile application (the "App") or any related services (together, the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use OTFT. If you are under 18, you represent that you have the consent of a parent or legal guardian. The Service is not intended for users under 13, and we do not knowingly collect personal information from children under 13.

3. Your Account

To access certain features, you must create an account using Apple, Google, or a one-time email verification code. You are responsible for:

Maintaining the security of the email address and third-party identity provider linked to your account.
All activity that occurs under your account.
Notifying us immediately of any unauthorized use at support@otft.app.

4. Subscriptions & In-App Purchases

OTFT offers premium features through auto-renewing subscriptions processed by Apple through the App Store. When you subscribe:

Payment is charged to your Apple ID at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel subscriptions in your Apple ID account settings.
Refunds are handled by Apple in accordance with their Media Services Terms.

5. Acceptable Use

When using OTFT, you agree NOT to:

Upload content you do not have rights to, or that infringes on another person’s rights.
Upload sexually explicit, violent, harassing, or illegal content.
Reverse engineer, scrape, decompile, or interfere with the Service or its infrastructure.
Use the Service to build a competing product or train any third-party AI model.
Share your account credentials, or sell/transfer your account.
Use the Service for any unlawful purpose.

6. AI-Generated Content

OTFT uses artificial intelligence (currently Google Gemini) to generate outfit recommendations and style analysis. You understand and agree that:

AI output is provided as-is and may contain inaccuracies or biased suggestions.
Styling recommendations are opinions, not professional fashion, medical, or psychological advice.
We do not guarantee any particular outcome from following OTFT’s recommendations.
You use AI-generated styling suggestions at your own discretion.

7. User Content

You retain all rights to photos and information you upload ("User Content"). By uploading User Content, you grant OTFT a non-exclusive, royalty-free, worldwide license to use, store, process, and display the content solely to operate and improve the Service. We do not sell your User Content. We do not use your private photos to train public AI models.

8. Intellectual Property

All original content, features, branding ("OTFT" wordmark and logo), and code associated with the Service are the exclusive property of Chaise Chumadevsky or its licensors. You may not copy, modify, distribute, or create derivative works without prior written permission.

9. Third-Party Services

OTFT relies on third-party providers to deliver features, including:

Google Gemini — for AI-powered analysis.
Apple WeatherKit — for weather data.
Supabase — for user data storage.
RevenueCat — for subscription management.
Resend — for transactional email delivery.

Your use of OTFT is also subject to the terms of these providers. OTFT is not responsible for third-party outages or data breaches outside our control.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OTFT AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $50 USD, OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Chaise Chumadevsky and OTFT from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by emailing support@otft.app.

14. Governing Law

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict of laws rules. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction there.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced within the App or via email. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
